Hey Kidz:

A certain Reluctant Cannonball informs us that Colin Moulding was in New York
City earlier this week to give testimony in the US District Court as a
co-plaintiff in the case of TEEVEE TOONS, INC. et al., Plaintiffs, -v-
MP3.COM, INC., Defendant.

The judge in the case, Jed S. Rakoff, found in favor of TVT, using stern
language in his opinion: "[MP3.com's] arguments are so unpersuasive on their
face as to warrant but little discussion here."

(Which, come to think of it, characterizes pretty much *all* the defenses
I've heard in favor of a system that gives away other peoples' work for free
without their permission.)

As you may recall, MP3.com settled a suit brought by a consortium of the
major labels ("UMG Recordings vs. MP3.com") earlier this month. According to
the Cannonball, MP3.com did *not* settle with the independent TVT -- his
succinct characterization was that "MP3 said 'fuck you!' to Steve Gottlieb."

Judge Rakoff (unfortunate name, that, in these graft-prone times!) has
brought down the terrible swift sword of justice on the miscreants. If you'd
like to read the whole opinion, I've put it up at
http://members.aol.com/hbsherwood/TVTSuit/tvt_vs_mp3.htm. Many thanks to Wes
Hanks for locating it so fast for me.

The Cannonball commented (quite heatedly, I might add), "I'm all for using
the Internet to distribute music--nothing wrong with that. But after twenty
years, I'm only *just now* starting to get a pay packet, and they're trying
to take even *that* away from me!"

So now you know how he feels about it. Please take this into account when
exercising your inalienable right to Free Stuff.

In other Cannonball news, Monday he took delivery on a spanking-new Macintosh
G4 to replace the Atari in the Shed. He's quite intimidated by the version of
Cubase VST he bought to replace his old MIDI sequencing software, but he
brightened when he was congratulated on his excellent taste in computers.
Like all the *best* geniuses, Our Brainiac, too, Thinks Different.

The Idea Records web site is being put together by Kabel New Media, a German
web design firm with offices all over Europe. It will contain an "XTC
Boutique" where you can buy XTC merch and recordings, plus scanned pages of
old notebooks, a photo gallery, and an area where you can listen to music
online--streamed, presumably. Its primary purpose at the moment will be to
promote the "Fuzzy Warbles" releases. I'm betting Macromedia Flash is
involved.

On the "Coat of Many Cupboards" front, they are still searching their
personal archives for old demos, listening to ancient cassettes and so forth.
Their arrangement with Virgin is that XTC will pack off anything they
find--down to the lowliest mumbled Dictaphone ideas--to Virgin. (Andy said
he'd just yesterday discovered an embryonic version of "Senses Working
Overtime" that had been hummed into a portable cassette.) Virgin will
"cherrypick" the best 15 of anything they get for the demos disk of the Many
Cupboards set. Absolutely everything else will revert to XTC in perpetuity,
for ever and ever until death do them part. This body of music will become
"Fuzzy Warbles."

Thus Endeth the Strike.

A droll anecdote about being hit in the face by a mud-filled brassiere while
onstage in Switzerland was recounted. This was followed by a list of objects
flung at the stage in France, far and away the most object-flinging-prone
country XTC ever toured:

     - wine bottles (full and empty)
     - cigarettes (lit and unlit)
     - broken glass
     - books (titles forgotten, unfortunately)
     - clothing
     - people (primitive crowd-surfing)
     - biscuits

This last item evinced an impression of a French guy departing for the XTC
gig, and going through his checklist of flinging supplies: "Eh, bien, I've
got zis volume of Sartre, oui, and my extra sweater, tres bon -- Ah! I 'ave
forgotten ze chocolate digestives! Zut alors!"

Paul McCartney had a much greater musical influence on him than John Lennon.
(Duh.) He *loves* Zappa. The pet question I've always wanted to ask him ("How
much Jethro Tull did you listen to as a youngster?"), spurred an anecdote
about Martin Vincent, the founder of Stray Blues and a total Tull fanatic,
who "borrowed" large portions of Partridge's record collection and sold it to
second-hand shops. Andy recently bought a copy of "Living in the Past" and
likes it quite a lot, and agrees that Tull must have rubbed off more than he
remembered. (Listen to "The Wheel and the Maypole" again, and tell me it
isn't crying out for a one-legged flute solo in the middle.)

this has probably been discussed here before, but here goes:
the cover of 'fossil fuels' (which i'm listening to at work right now) has a

Dave; according to "Song Stories": "...Gregsy's extraordinary high-speed
harmonized guitar.." Dave is the master of the technical, "Fanfare", solo.
Andy is no slouch either!! (Books are Burning?)...

and Yak, sjacobs@parkgrp.com quoteth:

Humm?.... I find nothing weird with songs about Hermaphrodites, Killer

with croquet mallets!!!?

Oh, probably some combination of both.
Since musical tastes are too subjective to argue about, I'll guess that the
bigger 'problem' is the lyrical content, judging from the backlash that has
occurred around these parts when the subject comes up.

Hello,

No, you're getting it all wrong . . . Andy is not re-recording any demos
that have been previously recorded, nor is he adding anything new to
them. All he is doing is remixing and remastering them to improve sound
quality, fidelity, lower tape hiss etc. He will be recording demos of
songs he wrote but didn't have time to make proper demos of however.

Well, I guess it's fairly obvious, looking at the "poll"...

For someone who writes 1/10th of what Andy writes, Colin's songs are not
looked on too favourably.

Gotta admit, I never liked Colin's songwriting as much as Andy's...there are
exceptions, however... One Of The Millions, Making Plans, Life Begins, Dying
(YES, Dying!!!)...

HOWEVER... I just CANNOT fathom an XTC album without Moulding tunes!!!

Maybe Colin is Ringo to Andy's John, Paul and George?

Could be...

Dear Sir Chalk-a-lots and Lady Birds,

Please, read before beginning your flame attack. Now, I may not know every
intimate detail of Andy's relationship with his (ex)wife, but I've read
Song Stories and listened to every one of his songs, so when I finally got
a chance to see the video for The Mayor of Simpleton again (on
Launch.com), I had a fresh new look at it. See, in the video, the lads
from Swindon are all dressed up funny in different costumes and a very
beautiful woman in a leather body suit is chasing Andy around, pushing,
shoving, hanging off of him. Now, in psychedelic text, each of the people
in the videos is given a name "Barry as the Fish", etc. Andy, Dave and
Colin all get cute names, as do the goldfish and dog in the video, but the
woman remains this nameless figure. Did I just miss it? I don't think I
did, as I couldn't keep my eyes off her, but the whole thing just seemed
to me to place little value as a person on the nameless beautiful woman in
the video, as if she's so unimportant. Anyone else see this, or do I just
read too much into these things?

Hi-dee-ho friends and neighbors,

A funny thing happened to me on the way to my mom's house the other
day. My son was going to spend the weekend with his grandmother, so
we packed his bag and then packed him into the car. I backed out of
the driveway, and at that moment I noticed a Man and his Dog on the
sidewalk. I'll call him Dave. So I rolled down the window and called
out, "Hi Dave". I know Dave because he walks his dog Crissy around
our neighborhood. I met him about five years ago. His dog likes my
dog, but my dog likes to pretend that Crissy does not exist. So we
talked for a few minutes, and then I heard some strange music coming
out of Dave's headphones. He wasn't wearing them, but the music was
still playing. I was immediately reminded of the film "Diva". So I
asked Dave what he was listening to. He said it was some
"psychedelic" music, Apples In Stereo. Well, I've heard of them, so I
asked Dave if he listened to XTC. His eyes widened. I said I'd heard
that Robert Schneider of Apples In Stereo was working with Andy
Partridge of XTC. Dave said a few things about XTC and Apples In
Stereo that he can repeat in this forum if he feels like it. So then
I asked Dave if he surfed the web. He said he did, and that he was on
Chalkhills. Ah ha! So I said, "I run Chalkhills. I'm John Relph."
You should have seen his face! My wife interjects that Dave started
talking about three times faster at this point.

A coincidence indeed.

Dave's favorite hat? Yeah, I've got one of those Chalk Horse hats,
too. Thanks, Phil!

Oh, my. I missed this one. I hope this Mr. Drude isn't serious. Do I have
to rend his knee jerk, uninformed opinion to tiny little shreds with factual
theoretical analyses on Lennon's extraordinary and ground breaking usage of
relative minor replacement, unusual resolutions of secondary dominants to
sub-dominant minor substitutions, pedal point 5ths and chromatic descending
tetrachord bass-lines, minor sixths, downward chorus modulations, half-step
pivot modulations on chromatic II chord substitutions, secondary dominant
breakaways from 12 bar blues based verses that eventually modulate in the
same phrase but still manage to return to the original dominant to pivot to
the verse, triple and double verse modulations (a la Jimmy Webb), odd-meter
and mixed time signatures (MUST I go on)? And that he was doing stuff like
this from the start? Many of these patterns that Paul did not use? And that
John couldn't tell you a damn thing about what I just said, that he was just
such an incredible natural original song-smith genius? And how his writing
has affected folks such as messers Partridge and Moulding?

Tsk, TSK. I suggest you don't get me started! :-0!

On a related note did anyone else here see the episode of the Powerpuff Girls
inspired by the Beatles? It was very very funny and deserves a place right
next to Spinal Tap and the Rutles.

I've ordered Homegrown. I was reluctant to given the price but I have the
feeling we're not going to see it over here any time soon. I was also
reluctant because I haven't listened to Homespun in quite some time while I
have listened to Apple Venus Volume One (which I have to agree is a better
album than Wasp Star. Wasp Star has many great moments on it but it doesn't
hold together as well as Apple Venus. It's kind of like comparing Abbey Road
to Let It Be. Wasp Star is exactly what it appears to be--the songs that
didn't fit on Apple Venus.

Anyhow, I suppose Homegrown will give me my Xtc fix while I wait for the
remasters. Any word on whether we'll see any DVD audio editions for their
best albums? Is Geffen going to reissue them here as well or is the contract
with Geffen up? I imagine Virgin would probably issues them here if the
contract with Geffen expired. One thing I have to agree with Vee about are
the digipaks. Hate them. If you're going to do it either go for the gusto (a
replica of the album in a cardboard sleeve with rice paper insert) or do the
jewel box. I'd prefer the later only because they can take a lot more abuse.

Now I know that Andy has been saying it was intended as a two CD set
originally, etc. but WS just doesn't gel when compared to AV1. Although the
finest moments on WS are every bit the equal of AV1 (Playground, Standing in
for Joe, Stupidly Happy and I'm the Man who murdered love, etc.).

Listening to Cheese and Onion as we speak...

Of course it was unfair and all that but I suppose the point I was making
was highlighting the ridiculous over the top statements that rabid fans make
about the swindon boys ie "Any of their bads songs ( if there were any,
which of course there are not, but if there were)
are way better than any other songs any other band has ever produced."

This kind of fandom reminds me of the kids i went to school with who only
liked either, Rainbow,Adam and the Ants, The Clash or whoever......
and would refuse to listen to anything else. It's slightly childish or
autistic.

I was also castigated by smudge boy for using the word twat. Again fair
enough, it was rather rude but then you might have noticed that I was told
to shut my f******* pie trap when criticising xtc.
I fight fire with fire sir. On guard!!

Anyways, Wasp Star is a piss poor album and that's that. tee hee hee.

I will wait for the reign of blows (another poor song) for that statement
and hang myself by saying that I like Semisonics new album.
It's got middle eights, hooks, melodies and everything. Ok it's not going to
change the world but then neither did Wasp Star.

picked out of the dusty boxes of archaic sounds machines in my attic was
We're only in it for the Money...and what a pleasant surprise! It was like
walking into an alternate reality where you could look at Rock music from
the outside in and discover for yourself why you love it so much...it
pleasantly warped me from then on and now if my music isn't a little "zany"
or is too "straight" then I have trouble really loving it. So my vote is
start there, and then move to his less Anarchic LP's of the Seventies..(save
Uncle Meat as a treat for later)

One more thought...I saw the Soft Boys this week in Boston and must say that
it was one of the best and best feeling "Rock" shows I've seen to in a long
time. Now they haven't toured since 1980..which you might think is a long
time ago. Yes it is, but can you think of another band who hasn't toured
since around that year?? Yup our friends XTC! Strange to think a band that
had been apart for 21 years could be so naturally good, but if they can do
so could XTC...now you all realize i'm speaking theoretically here...I
wouldn't force Andy out of his shed unless music failed to issue from
it..but just a passing fancy...ahhhh
Go see them if they come to your town..

How freakin' cool is dat?

A lad that I work with has never gotten into XTC. I've made him
compilations and such and it just never took. When Wasp Star hit I was
sitting in my ever-swank cube in the office playing it through my crappy
speakers. He turned the corner and just as Playground was cranking up
said "wow...what's that?" Well...he now loves the album. He's gone back
and gotten Apple Venus (sadly off Napster) and loves it too. He told me
the other day that he now wakes up thinking to himself "I've got to hear
some Partridge." He once hated Andy's voice...now he's addicted.

Hello All

Me again! My third post in 10 days! I reckon I will go back into
hibernation mode after this one though, so don't worry.

Just to let you know that Andy took delivery of a brand new pc on Wednesday
afternoon this week. Apparently, it is "for Erica", but no doubt the pair
of them will be surfing this way pretty soon, or maybe even join the digest
under a secret name (any guesses what that could be?) So from now on you
can send cryptic notes to him within these messages, and hope he's reading
them!!

I did drive past his house to see if he had dumped the packing boxes out for
the dustbin people, so that I could give you the make and model, etc, but
there was not a bin-bag or box in sight!

Over and out (for a while I expect, unless I've got another piece of gossip
for you).

Ain't that cool! You just never know! That poor guy must have lost control
of his bladder! I would have :-)

I discovered 4 neighbors who are XTC fans while we were at a Marshall
Crenshaw show in Annapolis last year. I was alone (husband had to work), so I
joined them for a drink before the show. We started yappin, and the talk
turned to bands we'd love to see in concert; I mentioned XTC; and the guys at
the table almost fell over. They "never would have guessed." Fun.

Thanks for sharing!

No relevance to the subject line.. just like the way it sounds!

Hello, friends-

My neighbor's orange tree is in bloom.. *nothing* on this earth smells
sweeter than orange blossoms.. mmmm..
Oh, yeah.. why I'm here-

To Ben who wants very much to embrace River Of Orchids (atta boy, Ben,
'wanting to' is the first step, pet!)
My relationship to music is based mainly on emotion and is hardly what you
would consider academic, so trying to convince you of ROO's greatness using
any technical rhubarb is out. So, Benji, I will tell you what I feel, o.k.?

In my eyes, ears (nose and throat), River Of Orchids is a garden gone mad
with bloom.. literally! ..it is also hypnotic repeating rhythms and counter
rhythms, brill touches of horn and string, and intensely visual lyrics that
mesh to create a fever dream atmosphere that is irresistible.. ..It has a
curious effect on me.. I go *elsewhere*.. And isn't it grand when a piece of
music can draw you in so completely that nothing else exists for the
duration of that song EXCEPT the ideas, images, and feelings that the music
conveys AND evokes..? You bet your granny's bloomers it is! Some of you
are probably saying to yourselves, "and I thought the corn grew tall in
Iowa!", but scout's honor, friends, I am sincere when I say that River Of
Orchids knocks me down.. in a wonderful way. If this hasn't swayed you one
bit, Ben, then I suggest that you have an adult beverage of your choice
(hell! have several) then pop on those headphones, crank up ROO, and do the
Partridge sprawl on your living room floor.. That is your last hope, dear
boy. Good luck, and Godspeed! <G>

And iffin yer ever passin' thru East Podunk make sure y'all stop in and

Defending some of McCartney's eighties work, Christopher Coolidge wrote:
"...Tug Of War has its moments, such as the heartfelt and
well-written eulogy to John, "Here Today." "Ebony and Ivory" is not one of
them though. I found Flowers In The Dirt to be an encouraging return to
form, it's the one Paul McCartney album in a long time to not have one
track on it that makes me wince. Having Elvis C as a songwriting partner
didn't hurt either. I must admit, though, the two best songs they wrote
together are on Elvis' Spike album. Avoid at all costs, though, the Pipes
Of Peace album, which includes one of his two collaborations with Wacko
Jacko. Feh...."

I couldn't agree more ( I'd also add Take It Away to Tug of War's finest
moments). By the way, all this made me think of which would be the XTCest
songs, if this is possible, of McCartney's solo work. Pretending that this
old and denied Macca's tribute album thing finally took place and that our
guys had no problem in participating, I would like to hear Dear Boy sung by
Andy and Bluebird by Colin.
( Dave Gregory should be there with the arrangements, also).

Any other suggestion?

Un saludo a todos,

Sebastian Aduriz, from Buenos Aires

My oh my oh.

Tut tut.

As I have been in the Museums of Edinburgh - as an exhibit naturally -
can I warn our more impressionable brethren that Mr Wilsher's discussion
of Thomas Chippendale's invention of the sporran is completely wrong.

It was of course Hepplewhite who came up with this invaluable aid, but
unscrupulous antique dealers have since attributed these umm interesting
pieces to Chippendale in order to charge higher prices. Many museums
have bought pieces in the belief that they were original Chippendales
but have since had to reattribute the pieces to Hepplewhite.

Perhaps, in light of this, Colin will change the lyric to reflect the
Hepplewhite connection:

"or maybe a hepplewhite
on girl's night out"

It has a certain ring to it n'est pas?

"Christopher R. Coolidge" mentioned worst songs:

> "Invisible
> Touch,"(Genesis)

I'd be more inclined towards "Illegal Alien" as the worst Genesis song
although it does get better if you're at that stage of being drunk when
you hang on to the floor to stop it moving so much.
Or is that just me?

Angie K-P wrote

My point exactly.
How could he not see something so obvious?

>Please, let's not tell him.

Aaah - I hadn't thought of that.
Maybe it's for the best - the needs of the many outweigh the needs of
the few.

So they're putting Dear God on the reissue of Skylarking, but at least
Mermaid Smiled is in the right place, and as they put it at the end,
well I can just programme it off the cd :-)

OK I'll buy it.

Highly recommended - Neil Finn's "One-Nil". I'll say just one thing
about it (stop worrying Adrian) - it maybe something of a surprise - and
yes the nil funn site is truly awe inspiring. Like Adrian I am in no
way etc. etc.

Finally if you haven't had chance to see the T shirt designs for the UK
Chalkhills do in Oxford, which also feature the Wretched Pietrap logo go
and have a look right now.

Pretty please?

Currently I'm not listening to anything as it's 4:30AM and I have an ES font
to finish before sunrise. Sunlight isn't - ahem ahem - good for me.

Children of the night - put a ruddy sock in it! I can't hear myself think.

Interesting facts about Chippendale furniture, I wasn't aware of that
connection. However, I don't care for any allegations that I was merely
having a laugh at somebody's expense and deliberately feeding false
information to someone trying to translate XTC into Italian, I was giving
my interpretations of those lines. Apparently I'm not the only one on the
list who saw it that way. "In Another Life" refers to many fantasy
scenarios and it doesn't seem unreasonable that this could be one of
them...

Is Colin talking about furniture or about beefcake? Knowing XTC, I would
wager it's a little of both.
